1. SCOPE AND GENERAL PROVISIONS
1.1. These General Terms and Conditions ("AGB") apply to all contracts, purchases, and orders concluded between Bvvc Spv Ix, LLC ("we",
"us", or "our") and the customer ("you" or "buyer") via our online store operating at http://zxdjq5-zh.myshopify.com/.
1.2. By placing an order for our products, including women's apparel, accessories, and clothing items, you agree to be bound by these General
Terms and Conditions. Deviating or conflicting terms provided by the customer shall not apply unless expressly agreed to by us in writing.
2. CONTRACT FORMATION AND ORDERS
2.1. The presentation and display of merchandise on our online store do not constitute a legally binding offer, but rather an invitation to place an
order (invitatio ad offerendum).
2.2. By clicking the "Complete Order" or "Pay Now" button at final checkout, you submit a binding offer to purchase the merchandise in your
shopping cart.
2.3. Upon receiving your order, we will send an automated order confirmation via email. This confirmation acknowledges receipt of your order
but does not constitute formal legal acceptance of your purchase offer. The purchase contract is formally concluded when we dispatch the
products and send you a shipping confirmation email.
3. PRICES, APPAREL SIZING, AND PAYMENT TERMS
3.1. All listed prices are displayed in the applicable checkout currency and include any applicable statutory sales taxes unless stated otherwise.
3.2. Shipping and delivery charges are calculated separately and clearly displayed during the checkout process prior to final order submission.
3.3. Sizing guides for women's apparel are provided on the product pages. Slight variations in fit or color tone may occur due to photography
lighting and display screen settings.
3.4. We accept various secure payment methods as indicated during checkout (including credit cards, PayPal, and instant online payments).
Payment must be completed in full before order processing and dispatch.
4. SHIPPING, DELIVERY, AND RISK OF LOSS
4.1. Products are shipped to the delivery address specified by the customer during checkout. Please ensure address accuracy prior to
completing your purchase.
4.2. Estimated delivery timeframes provided on the product pages or checkout screen are estimates only and do not constitute guaranteed
delivery dates.
4.3. If the buyer is a consumer, the legal risk of accidental loss, damage, or destruction of the goods passes to the consumer upon physical
receipt of the package by the consumer or a designated recipient.
5. RIGHT OF CANCELLATION (WIDERRUFSRECHT)
5.1. Consumers are entitled to a statutory right of cancellation of 14 days without giving reasons. Detailed information, instructions, and the
standard cancellation form are available in our separate Right of Cancellation Policy (Widerrufsbelehrung).
5.2. Returned garments must be unworn, unwashed, undamaged, and returned with all original tags attached. Items returned in worn or
damaged condition may incur a reduction in refund value due to loss of resalable value.
5.3. For health protection and hygiene reasons, sealed items such as intimate apparel, bodysuits, or swimwear where the protective hygiene seal
has been removed or broken are excluded from cancellation rights once unsealed.
6. STATUTORY WARRANTY AND DEFECTS
6.1. Statutory warranty rights apply to all products purchased through our store.
6.2. In the event of a manufacturing defect or non-conformity in garment quality, you are entitled to request supplementary performance (repair
or replacement). If supplementary performance fails or is impracticable, you may request a price reduction or contract rescission in accordance
with applicable statutory consumer protection law.
7. LIMITATION OF LIABILITY
7.1. We are liable without limitation for damages arising from injury to life, body, or health, as well as for damages caused by intent or gross
negligence.
7.2. In cases of slight negligence, our liability is strictly limited to the breach of essential contractual duties (cardinal obligations) and limited to
predictable, typical direct damages at contract conclusion.
8. PROPRIETARY RIGHTS & INTELLECTUAL PROPERTY
All trademarks, text, graphics, product photography, design layouts, and software content on http://zxdjq5-zh.myshopify.com/ are protected by
intellectual property laws and remain the exclusive property of Bvvc Spv Ix, LLC or its licensors. Unauthorized copying or redistribution is strictly
prohibited.
9. APPLICABLE LAW AND DISPUTE RESOLUTION
9.1. These General Terms and Conditions shall be governed and construed in accordance with applicable governing laws. Statutory rights of
consumers residing within the European Union or other applicable jurisdictions remain unaffected.
9.2. European Union Online Dispute Resolution: The European Commission provides an online dispute resolution platform at https://
ec.europa.eu/consumers/odr. We are neither obliged nor committed to participate in dispute resolution proceedings before a consumer
arbitration board.
